By accessing or using Shag ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Shag is an X (formerly Twitter) Auto-DM platform that helps creators automatically send direct messages to users who engage with their content. The Service includes keyword-based campaign triggers, DM automation, engagement monitoring, and analytics features.

3. X Platform Compliance

By using Shag, you agree to comply with X's Terms of Service, Developer Agreement, and Automation Rules. You acknowledge that:

You are responsible for all DMs sent through your connected X account
Automated DMs must comply with X's spam and automation policies
X may suspend or terminate your account for policy violations
Shag is not affiliated with X Corp and does not guarantee platform access
Changes to X's API or policies may affect Service functionality

4. User Accounts

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account
Only connect X accounts that you own or have authorization to manage

5. Free Trial Terms

All plans include a 7-day free trial. During the trial period:

DM limits are capped at one day's worth of your selected plan (monthly limit ÷ 30)
No credit card is required to start a trial
Trial periods are limited to one per user/X account
We reserve the right to limit trial features or terminate trials for abuse
After the trial, you must subscribe to continue using the Service

Trial DM limits by plan: Starter (~100 DMs), Creator (~250 DMs), Business (~500 DMs).

6. DM Limits and Fair Use

Each subscription plan includes a monthly DM limit. You agree to:

Not exceed your plan's monthly DM allocation
Not use multiple accounts to circumvent limits
Not send DMs that violate X's policies or spam guidelines
Accept that unused DMs do not roll over to the next month

7. Acceptable Use

You agree not to use the Service to:

Send spam, unsolicited messages, or promotional content to uninterested parties
Harass, threaten, or abuse other users
Distribute malware, phishing links, or harmful content
Impersonate others or misrepresent your identity
Violate any applicable laws or regulations
Send DMs promoting illegal products or services
Attempt to gain unauthorized access to any part of the Service
Resell or redistribute the Service without authorization

8. Content Ownership

You retain ownership of DM templates and campaign content you create. By submitting content, you grant us a limited license to process and deliver that content through the Service. You are solely responsible for ensuring your DM content complies with all applicable laws and X's policies.

9. Payment Terms

Paid subscriptions are billed according to your selected plan (monthly or annual). You agree that:

Subscription fees are charged in advance
Annual subscriptions provide a discount but are billed upfront
Refunds are generally not provided for partial billing periods
We reserve the right to modify pricing with 30 days notice
Failure to pay may result in account suspension

10. Limitation of Liability

To the maximum extent permitted by law, Shag shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:

X account suspensions or terminations
Lost business opportunities or revenue
Service interruptions or API changes
Unauthorized access to your account

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
All DMs will be delivered successfully
X's API will remain available or unchanged
Your X account will not face restrictions from X

12. Indemnification

You agree to indemnify and hold harmless Shag and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account at any time for violation of these terms. You may terminate your account at any time by contacting us. Upon termination:

Your right to use the Service will immediately cease
Active campaigns will be stopped
You may request export of your data within 30 days
No refunds will be provided for remaining subscription periods

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
